Legal Question in Family Law in New York

Child Support Requirements

If a divorced father is living with someone and the mother of his child obtains an order of child support, is the income of the person he's living with included in the determination of the monthly amount if the parties are not legally married and have not been living together for 7 years?

No.

There is no "Common Law" marriage, in NY.

You ARE legally marry, with all OF the attendant rights and obligations re the other party, or you are NOT married. YOU ARE NOT "married" merely by virtue of living together.

Good luck,
