Legal Question in Family Law in New York

child support after I retire

I will retire from the military in 2 months. My Ex is getting HALF of my retirement pay as ordered by the court. My child support is $1,000 per month for 2 kids. I have no job lined up, I will probably end up in foreclosure. How do I stop the child support?

Re: child support after I retire

If the case is a NJ case, you would file a Motion to reduce your child support based on substantial change of circumstance. It may be premature, however, since the Court would likely require you to show attempts that you have tried to obtain a job and could not do so. Also, your chances of success may be affected by any unemployment monies or other sources of income.

Keep in mind that this advice is given based on the little bit of information that you have

provided in your question. My advice may change based on other information. Further, no one

can rely on advice from an attorney who has not been retained. You cannot rely on this advice

because we have not personally met and you have not retained me as an attorney. If you have not

already done so, you should immediately meet with a Family Law attorney for a full consultation before you take any further steps. Good luck! Rob Gleaner

You need to go back to court to modify your alimony so that you can pay child support. You have significantly changed financial circumstances.
