Legal Question in Family Law in New York

Child Support after Retirement

I will retire in approximately 2.5yrs. I have owned my home for 2 yrs now, and would like to know, should I sell my home with sizable profit, would my ex wife be entitled to a portion of that profit. It may exceed over $100,000.

Also, upon retirement and collecting Social Security, can I have my child support payment adjusted for the reduced income? There will be one dependent remaining who will be 18yrs old, and most likely in college.

Re: Child Support after Retirement

It is often the case, that after a divorce a person has an "aversion" to dealing with their divorce attorney. However, before you proceed or need to retain other counsel (and to get answers to your questions), YOU need to have an "in office" consultation with your divorce attorney.

It is important for you to review, with your attorney, all pertinent documents, and representations made during your divorce proceeding and all stipulations, agreements and Orders, that may have been entered. This information is needed before your questions can be answered; or you can have a "best course of action."

Good luck
