Legal Question in Family Law in New York

Child Support

Hi

My sister has a child support order for 10 years that has been unpaid by the father. She has called every agency for help with this matter.it is currently with the District attorneys office for the past 3 years. they say they will not arrest him because they cannot prove he has income although he drives around in a car under his girlfriends name and has a boat also under her name. He has never appeared for a court hearing and has not been arrested for failure to appear. He won a $45,000 lawsuit that was paid but by the time the DA s office found out the money disaapeared. He works off the books and changes jobs alot.

It seems that no one is willing to spend the time on this case. We have given all the info that the Da request but by the time they get to it it is no longer relavent. He now owes in excess of $40,000. HS LICENSE WAS SUSPENDED BUT HE WENT TO COURT AND RECIEVED A RESTRICTED LISCENCE BASED ON HIS STATEMENT THAT HE HAS TO PICK HIS CHILD UP FROM SCHOOL,HOWEVER HE HAS NOT SEEN HIS CHILD IN 2 YEARS.

IS THERE ANYTHING MY SISTER CAN DO?

THIS PERSON HAS $$$$ TO PAY BUT REFUSE TO HELP IN SUPPORT IN ANYWAY.

THANKS

DAN

Re: Child Support

It may be necessary to obtain an order holdng him in contempt of court. Jail time may convince him to pay.

Re: Child Support

Go to our site at www.millenniumdivorce.com and look under children for the link for child support. There are support collection services available to your sister that will pursue collection. These are fee based services. However, they only collect a fee if they collect the child support. That may be an option for her. It sounds like you have exhausted many of the other options and going to court can cost a lot of money.
