child support

My son is married with 1 child (which was from invitro fertilization). He is not working due to a car accident injury. He, his wife, & child are being supported by my husband. The wife refuses to get a job to help. The marriage is on the rocks,and my son is worried she will get preg.again-in vitro.Can he order the sperm bank not to impreg.her without his permission.They will probably be heading for a divorse, and my son doesn't want to be responsible for paying for 2 children. What are his rights?

Re: child support

Child support in New York is granted under a section of the Domestic Relations Law that contains a formula with what are considered minimum standards. However, it is possible to opt out of that formula under some circumstances - and Courts can modify the award based on certain factors. In vitro fertilization, however, is not one of those factors. A child whose birth stems from such an in vitro procedure is treated identically with any other.
