Legal Question in Family Law in New York
Child Support
I have a 18 year old daughter whom I received child support court order. The order was taken out in NYC. My daughter and I have moved to New Jersey a year ago and the father lives in Georgia. My question is am I still entitled to support by moving to N.J. and how long is entitled to pay. If my daughter moves out on her own does the father still have to pay. What would be some of the reasons that he would not have to pay support

Re: Child Support
Q. I still entitled to support by moving to N.J.
A. Yes.
Q. How long is entitled to pay.
A. He must continue to make payments until emancipation of the daughter.
Q. If my daughter moves out on her own does the father still have to pay.
A. If your daughter permanently moves out, she would be considered emancipated. He does not have to pay although technically, he should bring an action to terminate child support payments.
Q. What would be some of the reasons that he would not have to pay support.
A. Emancipation of the minor. Permanent custody of the minor with the father. Release of obligation by the mother.
