Legal Question in Family Law in New York

child support after 18 years of age for college

I lived with my father under very strenuous conditions. In 2000 two months prior to my 18th birthday I left his house to live with my grandmother. In the three years since I have had continuous difficulty in paying for college. My question is although I left am I entitled to any money from him for the last three years. Let me state that he has not given me a dime. I was told that up until 25, but I just want to confirm. Thank You

Re: child support after 18 years of age for college

In New York, both parents are obligated to support their chldren until age 21, or earlier emancipation. Moving out of your father's home may constitute emancipation, depending on the circumstances. Child support payments are generally an obligation of the non-custodial parent for the benefit of the cutodial parent's household; if you're not emancipated, then it may be that your grandmother is entitled to support payments. How did your father come to have custody? Is your mother in the picture? Feel free to call me at 212-367-9167 to discuss your case. Good luck,
