Legal Question in Family Law in New York

Child Support/Child Custody

My wife moved out of New Jersey on the 25 th of May and filed for Child Support & Child Custody/Visitation on the 30th of May.

I have another court date for Child Custody in our home state. It was file after receiving a letter from the courts in New York. The only reason for me filing was because , my wife stated that she will not keep my 2 daughter away from me.

So I took the proper procedures and filed in our home state.

I would like to know how do I go about dismissing the court date in New York?

I was told New York does not have jurisdiction over this case because New Jersey was my childrens last known address and they didn't reside in New York for more than 6 months.

What papers would I need to file?

Re: Child Support/Child Custody

You need a motion. The NY Court's clerk's office may be able to help you, however interstate child custody is not an easy thing even for attorneys. You should not be handling this yourself. Please for the sake of your kids, get to an attorney.
