Legal Question in Family Law in New York

Child Support/Lottery Winnings

I pay child support every week as stated in my divorce decree. I am remarried and have been divorced since 2003. Does my ex have any right to my lottery winnings? We are talking millions.

Thanks,

Re: Child Support/Lottery Winnings

Your ex should not have any rights to your lottery winnings after the divorce, unless you have joint outstanding debts.

Re: Child Support/Lottery Winnings

Your spouse can request an increase in child support payments by claiming a change in circumstances. She cannot, however, receive any money for herself from your lottery winnings.

She would need to show not only a change in circumstances, but that your child has needs that are not being met.
