Legal Question in Family Law in New York

child support/real estate

I own a piece of real property with an ex-boyfriend-we were never married-he has been out of the house for 3 years on an order of protection-he owes approx. 15000.00 in child support arrears. How can I get the support court to award me the house as payment of arrears to remove his name from the deed?

Re: child support/real estate

You can't.

He owns 50% and since you are not married the court can not award you the home.

However, they can give you a judgment which you can lien against his share of the home.
