Legal Question in Family Law in New York

Child Support/Visitation

My son's father was ordered to pay support every week from the day our son was born. He has failed to pay this support, and now we are going to court for custody/visitation. He has never seen his son, he has never taken him, or cared for him since the baby's birth. Can he get visitation owing almost ten thousand in back support? What kind of visitation would he be allowed? There is an order of protection between him and I that include my immediate family, and i was told that that covers my son. What is the chance that the order of protection could be dropped if he petitioned the court?

Re: Child Support/Visitation

The O/P cannot be "dropped," unless you consent. However, it can be modified to permit the father Supervised visitation. Supervised visitation can be ordered at an agency, or another third party present with the father and child throughout visits, that you do not need to attend.

GOOD LUCK,
