Legal Question in Family Law in New York

child visitaion

My wife was given exclusive use and occupancy of our marital home with our 4 children. We continually argue even after our seperation was signed. Can I go to the marital home to pick up the children for visitations or can we meet else where?

Re: child visitaion

Assuming that there is no stay away order in place, and assuming there is no other agreement in place concerning where you should pick up the children, you should be able to go to the marital residence to pick up the children for visitation.

I would recommend that there should be little conversation between you and your future ex since you really do not want to fight in front of the children.
