Legal Question in Family Law in New York
child visitation
Hello,
My child's father served me with summons for child visitation. He's been seeing the child for a year now after our separation at my mother's home. He knows my address but in the summons he stated ''unknown'' and that his address is confidential. I feel that he is using our one year old child to hurt me. I will grant him as many visits as he wants but i don't feel comfortable with allowing him to take the child out. He was arrested for trespassing and found alone in a roof. He was arrested. Please help me, tell me what I can do or say to avoid my husband from taking out our one year old son.
Thank you.

Re: child visitation
Generally, the non-custodial parent and child are entitled to reasonable time with one another, which would typically include overnights and possibly more extended time away from the custodial parent's home. Custody and visitation are determined in accordance with the best interests of the child; if you want to restrict your husband's time or activities, you should be prepared to show good reasons why such restrictions are necessary for the well-being of your child. Feel free to call our office to discuss this further.
