Legal Question in Family Law in New York

Child Visitation

In my parenting plan from 2004 that needs to be reevaluated. The Visitation was very broad in the area of when and scheduled times for visitation. I am active duty Army and at the time lived in the barracks, so I could not have my daughter visit me for any real lenth of time. Since then i am remarried and own a home. Is it concievable to be able to get the summer and holiday visitation schedule redone?

If the child and mother reside in New York Your, you must go to Family Court in the County in which they reside and petition for a modification of visitation. The courts are very liveral in cases such as yours, where the other parent lives a distance away, and will lump visitation to cover most hollidays, and during the sumer/vacation areas.

Certainly. You need to petition to modify custody. Our firm has done this a lot. Obviously things change in people's lives, and the court knows this.
