Legal Question in Family Law in New York
children have abandoned me
I am divorced and have a visitation schedule that is grossly ingnored by ex and children. To them I am good for money only. In the last year I have seen my children 6 or less times. Is there any nys law concerning children abandoning there father. If so, is the father expected to pay support (of which I have right along) is there any defense against the ex who refuses to support herself-child support payment is her paycheck. How do I defend myself against ex who discourages visitation & poisons minds of 12 & 9 year old?

Re: children have abandoned me
While your frustration is understandable, under no circumstances would I recommnend you cutting off support payments. If you did so, you could find yourself facing wage garnishing, tax refund liens and, at worst, incarceration.

A more proper response to your spouse's failure to comply with a court ordered/stipulation of visitation is to retain an attorney who would file the proper legal papers to have your custody dilemna considered by the Court. If the Court finds your spouse in default of the custody order and she fails to correct her default, she could face court ordered sanctions.
