Legal Question in Family Law in New York

Children's rights regarding visitation with non-custodial parent

My daughter is 13 (birthday - 5/27/87). I am custodial parent. I have been divorced for 11 years. Our separation agreement requires my daughter to visit with her father Wed. evenings and every other weekend 6:00 Fri. - 6:00 Sun. Does she have any right to not visit her father on the required times/days? Does she need to wait until she's 18 to have that right? Is there an earlier age?

Thank you.

Re: Children's rights regarding visitation with non-custodial parent

This is always a tough problem. Personally, I think that it is more of a psychological issue than a legal issue. Experts state that as the custodial parent, you should encourage visitation with the father. Never, never, never disparage the image of the father in the eyes of the child.

I think that it would be better for you to seek help from either a child psychologist or a social worker rather than an attorney.

Mike.
