If you and your husband are both in consent to file for divorce; both will sign the necessary documents and at least you will be able to appear before the judge on the day of the hearing, you can file for a fast divorce by mutual consent pursuant law 142 in Domiican Republic. Your husband, depending on how the process is conducted is in danger of being deported. Supreme Court Matrimonial Parts are not usually in the business of reporting immigration status to the Immigration and Customs Enforcement agency (ICE). You can wait for the new no fault divorce law to go into effect on October 12, 2010. That law will most likely give you the best chance to keep this from becoming seriously involved.
Although my office is in Nassau County, you can contact me for further assistance if you choose to. I personally do not recommend the Dominican Divorce route since you are an American Citizen and you do not want your child to be placed in any legal issues if this goes that way. Be aware, your child is very very unlikely to be effected by any process no matter where you do this. If your child was born in the US and you are a citizen the child is not going anywhere.
