College Expenses

My child is coming up on his college years. I pay child support of 25% to my ex. If she trys to take me to court to pay for college what can I expect? What do the courts usually do in this case in NY? Can I be expected to pay child support and college? What about room and board? I have heard they can make you pay based on a pro rata of income but I think to pay child support and college is a double dip and would not be fair to make me pay both. Also who says I have to pay for college? Going to college is a privledge not a requirment. I want them to go, but would like the ex to pay her fair share.

College (the costs and expenses), is not child support, nor a "required" "add on" under the child support rules.

However, if the parents are professionals or have attended college, the court presumes that payment of college is a "just and appropriate" charge, and tries to "persuade" the NCP to pay toward the additional costs.
