Legal Question in Family Law in New York

Common Law Cohabitation

My boyfriend is separated from his wife and we have live together for the last 4 years, he has insurance with his wife as the beneficiary but he wants to get a separate policy for and make me the beneficiary. If something happened to him would I be able to collect. we all live in New York state and he was married in New york state.

A life insurance policy is distributed outside a will. Therefore, if your boyfriend (or you) purchases a life insurance policy naming you as beneficiary, upon your boyfriend's death you would receive money under the policy.
