Concerns about moving (international)

I have sole custody of my soon to be 7 yr old daughter. We are thinking about moving to be with my fiance in Australia. We will decide after a brief visit to ensure my daughter is comfortable with the area and schooling , friends and family there. I am curious to know what recourse her mother has. Her mom maintains a relationship with Her @ 30 min on mon wed and fri mornings between 7am and occasionaly on a thursday . All of which are at my house, Over 5 yrs she has only taken my child to her house with her Boyfriend 3 times. I have asked repetedly for us to take up family consuling as well as try to open up some sort of comunication with the mothers Boyfriend, and denied on all counts. My fiance has tried to converse with my childs mother , but is also rejected the common courtesy of a reply. Our intended move in uncertain as I want my child to have an informed descision in this process. Although it is a ways off (as my child will be into her next school yr before we can even visit) I have informed her mother of my intentions to move and marry if all works out in such a manner.

The judge in your case will probably have to consider all the facts if she challenges your move or you have to get court approval for it.
