it's my condo...who goes? me or her?

i'm pretty sure i'm heading for divorce...tensions are high in the condo i've owned for 3 years before the marriage...who should leave? me or her? do i have a right to ask her or have her leave?

There's no set rule as to who stays or goes. While the condo was your property, because you owned it prior to the marriage, your soon to be ex may be entitled to a portion of its value, depending on a number of factors, including the length of your marriage and the way that the mortgage, if any, and condo fees were paid during the marriage.

Other factors may also play into how a court would view your case, including whether you have children, where they will live, etc.
