Legal Question in Family Law in New York
confused and need help
I have a question. I am engaged to a man not my sons biological father. His real father has never been there, never signed his birth certificate or payed 1 single red cent in child support. Basically since he found out I was pregnant he has disappeared into a black hole. BAck to my question from what I read online for my fiancee to be my sons legal guardian he would have to adopt my son. How would I go about doing that without having to contact his real father. Because I honestly have no Idea where he lives or anything like that and if I do find a way to get in contact with him and signs away his rights would he still have to pay child support. Also if he signs his rights away can he go back to court and have them reverse the order. Also my fiancee has 2 kids from a previous relathionship would he still have to pay child support even thought he did not sign the birth certificate . But he has to pay child support but only if he wants to because he is currently reciving money from the goverment. Any help would be greatly appreciated. Iknow its kind of long but just trying to cover evrything.THanks so much.

Regarding your question about the birth father's consent to adoption---there are certain legal requirements that a man must meet in order to be notified of an adoption and another set of legal circumstances where a birth father must give his consent to an adoption. I can further discuss this issue with you in your situation. From the facts you have given so far, it appears that you may not need his consent for an adoption because of his lack of involvement. However, I could not tell you this for certain until I get a few more facts. I am an adoption attorney and would be happy to help you. Please email me at: [email protected]
