Constuctive Abandonment
My husband filed for divorce because he said he didn't love me anymore. When my lawyer received the paper's the divorce was based on Constructive Abandonment'' I told my lawyer that my husband and I did have sex. He told me to get my husband on tape,
saying that we did have sex, so I did.
Knowing that my husband lied which he says he didn't know what constructive Abandonment was, will this case be dismissed when the judge hears my tape??

The action may be dismissed since in New York a plaintiff must must prove grounds to obtain a divorce.
