Legal Question in Family Law in New York

No contact in 5 years

I have not heard from my husband in 5 years since I had initially told his ''girlfriend'' to tell him I wanted a divorce the have both managed to be evasive. I live in NY and I think they still live in NV. how hard will it be for me to get a divorce and can it be inexpensive since I do not make much and I am single parent of a 13 year old (not his) born before my marriage to him. I really want to get on with my life I have considered the fact I might start dating again.

You might consider filing and proceeding with your divorce "Pro Se," to save yourself the attorney retainer and fee.

However, if you decide to proceed that way, you should consult with an attorney, before proceeding.

Note, the Court can also waive their costs and expenses, if you qualify based on your income status. However, costs, expenses and disbursements for "Service" and "Publication," (as may be necessary) for the Divorce, might not be waived.

You can download, copy or purchase a Uncoontested NYS State Divorce Kit from the Court site, Blumberg, etc.. Which kit includes detailed instructions.
