Contempt

we are in the middle of a custody battle for my step son. we were court ordered to have a custody evaluation by the judge. we all showed up for the evaluation but my step son's mother has not paid so the evaluation will not be released. Because of her non payment she did not show up for her follow up visit and never handed in her test. Could this be considered contemt of court?

It depends on the language of the order directing the examination and payment by the parties. However, non-payment by one of the parents should not be permitted to hold up the report and the entire case. Your attorney should be trying to get the report from the examiner or asking the court to to so. Feel free to call my office to discuss your situation in further detail.
