Legal Question in Family Law in New York

Contested Divorce Case/No Children/Equitable Distribution of Marital Assets

Wife is suing for divorce. Her name is on the title and mortgage exclusively. We have no children. Are there any criteria for division of this asset. Is the home equity divided equally or are there other factors considered? Is the distribution of this asset based on the contributions of each spouse. If so, what consideration is given?

All of the factors you cited are considered, as well as the length of the marriage, your income age and health and a myriad of other factors.

I suggest you consult or speak with an attorney.

Your situation is far too complicated to discuss via the internet. Equitable distribution means that. The assets are distributed equitably ,with consideration given for prior contributions to joint assets. You may call my office @7188340087 to set up a consultation.

The name on the title and mortgage is not determinative of the way a court would handle the equitable distribution of the home - there are a great number of ofther factors that are considered.

If you'd like to discuss the matter more fully, please feel free to contact me through the link below to arrange a consultation.
