Legal Question in Family Law in New York

contested divorce new york

My husband doesn't agree to divorce.

I may need to move to CT for 1 yr to

establish residency & file from there.

I live in Long Island - it will be more

than an hour away from kids - will I

be considered to be abandoning

them? Can I stay 3 nights in current

home & 4 in CT to maintain

residency there but not abandon

kids? I am monied spouse.

I WOULD RECOMMEND YOU FILE IMMEDIATELY IN NY, JUST BECAUSE YOUR HUSBAND DOES NOT AGREE TO DIVORCE DOES NOT MEAN IT WILL NOT BE GRANTED IF YOU HAVE GROUNDS AND THE GROUNDS CAN BE PROVEN. HOW OLD ARE YOUR CHILDREN?DO THEY WANT TO LIVE WITH YOU, OR DO YOU BELIEVE THEY WANT TO LIVE WITH YOU?

THE PROBLEM WITH FILING IN CT IS NY WILL HAVE JURISDICTION DO TO YOUR CHILDREN RESIDING IN NY.
