Legal Question in Family Law in New York
Continuing a case after paternity results show he is the dad
I have two questions that I would like to be answered. We went to court and the paternity test was taking and came back stating that he is my child's father. Now we will start the child support order. But since then he has moved (still living in New York) but I do not have an address. 1) Can they find him and locate where he is to continue the case? 2) If he is not working at this moment, will they help him to find a job? What will happen?

Q. 1) Can they find him and locate where he is to continue the case?
A. The father was already served with a copy of the petition and has appeared in Court. The court already has jurisdiction over the father and he is required to appear in Court. There is no need for futher notification. If if fails to appear, the Court will issue a warrant for his arrest.
Q. 2) If he is not working at this moment, will they help him to find a job?
A. No.
Q. What will happen?
A. The Court will apply the guidelines set forth in the Child Support Standards Act to the father's salary prior to his resignation.
Mike.

You are in good shape on this one. the court already has jurisdiction over the man because of the prior petition. This part is merely a continuation.
ACS is a draconian, nasty, and aggressive organization that can freeze his bank accounts, suspend his drivers license, and other things. The man will not get away!
good luck.
