Legal Question in Family Law in New York
Cost of living adjustment added to child support obligation
I have been divorced for 5 years and pay 31% of my adj gross income for child support. This amount is about $1980/month. I received a letter from SCU stating that they will be increasing my support by 12% to $2147 a month due to the COLA. Do I have any grounds to object this order? Does the fact that I have two other children with my new marriage matter? Also, my ex-wife presently works and she didn't at the time the original support order was issued.
Thanks for any advice.
Anthony

You should contact a qualified attorney IMMEDIATELY. You do have a limited period of time within which to object to the COLA increase. It may or may not be adviseable to make such an objection, however, depending on your income and other circumstances. You really need to speak with someone right away.
