Legal Question in Family Law in New York
Cost to review postpostnuptial agreement
Approximately how much does it cost to have an attorney review a postnuptial agreement? We have a boiler plate document that basically spells out that we each keep what we make during the marriage, and that our share in the equity of our apartment is proportional to our contributions to it. To help increase it's enforceability, we wish to each have an attorney look at it and certify that we understand it, are not signing it under duress, etc.

That is, of course, the problem with forms. You cannot know if the form will hold up in court to mean what you want it to mean! The words in the form may be interpreted by the court in a way that does not coincide with your mutual intentions.
A review of the document alone is inexpensive. We would charge you for one hour (at our billing rate of $350 per hour) to discuss your intentions and review the document. From there, we would tell you what changes we thought would be necessary, if any. If you wish to arrange for a consultation for this purpose, please call us at (212) 267-7000
Re: Cost to review postpostnuptial agreement
Needless to say, your intentions are that the agreement will not be challenged later on; but if challenged, it will be enforceable.
Thus, not only should the agreement should be reviewed, but also the procedure that was followed in preparing and signing it.
Most attorneys will probably charge an hourly rate for their services. In most cases, the total fee should be less than $400 for a thorough review.

Re: Cost to review postpostnuptial agreement
My congratulations on your upcoming marriage. may the pre-nup only gather dust!
If the form is from Blomberg or other NY document seller, it is likely that it will be sufficient. (Remember to get the signatures witnessed and notarized!)
Assuming that each party is a college graduate and the agreement is simple, 'in case of divorce my spouse does not get ____________ .', it is overwhelmingly unlikely to be found inadequate.
The key is not in the list of stuff, but in the fact that each party knows what the law is and decides to agree to the pre-nup rather than accept the law on this matter.
Unless there are some very complex financial matters (trusts, closely held corporation corporate assets utilized by one spouse, etc.), a review like this will likely take about 30 minutes and my fee would be $150 and the meeting would be at 42 west 44th street, near Grand Central.
Again, if each party is aware of what the law entitles and signs the contract, that would make it enforceable. The certification by an attorney would merely indicate that the legal issues were explained to each party.
