Legal Question in Family Law in New York
court ordered visitation
visitation order violated by noncustodial parent , simply did not visit. order suspended then 6 yrs later noncustodail parent resurfaces requesting visitation. during absence noncustodial parent attended college and ran for public office. child is 12 1/2 does not wish to visit with noncustodial parent who has been absent since 2001, how can i advocate for my child's wishes. it is costing me to defend myself against the request for visitation, and while my income is high my debt is greater and i do not believe i will qualify for free legal rep. i don't have extra money to hire a lawyer so what recourse do i have ? is my only option to represent myself?

A. You cannot. You would need an independent attorney for your child.

A. You must request free legal counsel before the Family Judge. Let the Judge make the decision if you do not qualify for representation. Furthermore, the Judge will probably assign an attorney to represent the child.
