Legal Question in Family Law in New York
My cousin has 3 children and they have been taken away from her by social services. She is working on getting them back and doing everything that the courts are asking her to do. Each of her kids were placed in one of her husband's relatives home for the time being. Her husband is very controlling and is causing many problems for her because he just got her arrested on a technicality, but when she went to get an order of protection against him, she was denied. He has been stalking her and watching her every move hoping that she will make a mistake because social services is considering giving him the kids. He is also a drug addict but there is no way to prove it because they courts and social services do not want to investigate it. If my cousin was to tell them her suspicions, then social services will somehow turn it around and think that she has been using. Also, he has been stalking her and following her to her programs and confronting her about who she has been with and what she is doing, but the only problem is that she cannot prove it because it will seem like she is the one doing the stalking.I have just a few questions: 1) Is there anyway to prove that he has been following her without compromising herself?
2)Does she have a chance of re-cooperating her children even though she has been arrested due to her husband's dirty ways?
3) How should she deal with social services if the social worker tells her that seeing her children depends on if the current guardians agree upon it and then turns around and tells the same guardians to not let her see her children?
