Legal Question in Family Law in New York
My cousin is a violent alcoholic and is currently living in my aunt's (his mother's) home. They have a troubled co-dependent relationship. Recently, he was arrested and jailed for threatening her with a gun in her home. He was roaming her farm with a rifle, and was witnessed by several neighbors. He was taken into custody by a team of more than 15 police units. In the midst of this, a (non-temporary) order of protection was issued barring him from having any face-to-face contact with my aunt. He is now out of jail, and has returned to living in her home, violating the order of protection. She has chosen not to enforce the order of protection by reporting this to police. I fear for her safety, as well as the safety as the neighbors. If she choses not to enforce the order, is it possible for a neighbor to call in the violation to enforce the order? Or is she the sole individual that can enforce it or issue a complaint?

Any one can make a report that a dangerous person (or felon) is in direct contact with his victim.
