Legal Question in Family Law in New York

custodial grandparents moving out of state

My husband and I have physical custody of our grandson. Its joint custody with his mother, but we are primary. We've had him since he was 1 and have had permanent custody since he was 4. We want to retire from NYS to Fl. We need her permission. What steps can we take to make this happen if she doesn't agree? Thank you!

Correct, you would need her permission. If she does not consent, you would have to petition the Family Court to move.
