Custodial parent moving child out of state

I have permanent physical custody of my 9 yr old daugter. Her mother has joint legal custody w/every other weekend visitation yet she hasn't seen her in months. My daughter doesn't want to see her and has only visited with her a handful of times over the past 2 yrs. Abuse from her mother played a part in my receiving custody 3 yrs ago. I would like to move to move to Utah where I have immediate family and a very good career opportunity. I know that my daughters mother would have a problem with this. Do I have any options? Must I remain in New York until my child reaches 18yrs old?

Hi:

This really depends on what your settlement document provides. However, that being said I would suggest that you speak with counsel to see if you have grounds to modify the document and move out of state.
