Legal Question in Family Law in New York

Custodial Parents Support Obligation When 18 Yr old moves out

I was divorced 5 years ago and rec'd legal custody of both my son and daughter. I rec'd residential cust. of my son, while ex got res. custody of daughter and I give support for daughter. My son decided to move out and in with his mom. My ex is threatening to take me to court for support payments for him. What is my legal obligation in this matter. My son left on his own volition. I am paying for 1/2 of his college education and some expenses by free will but can I be forced to make support payments in this situation? Thanks!

Check the actual court order that gave custody and awarded child support. It should deal with this situation.

If not, then your ex may petition for a modification.

Thgis looks like a drafting error by your old lawyer.
