Custody Adjustment

I entered into a divorce agreement with my ex-wife in 1997 in Illinois. We have joint custody of our daughter. Neither of us can move from Illinois, or the agreement is violated. My question is, can we make a new agreement to live in another state? We both want to move to New York state, but we don't want to lose custody. Can we re-do the agreement, so that it is binding in New York state instead of Illinois?

Hello. In my opinion you

should be able to get the

court to go along with

your desire, if you file a

motion for removal of your

child to New York and you

properly present it as

an agreement between you and

your ex-spouse. However,

I would not suggests trying

to represent yourself; hire

a lawyer to lead the way!
