custody agreement

My ex husband and I came to agreement for joint legal custody having shared responsibilty of our children.after the order was signed he moved in with his girlfriend and the children are living in my home primary.can i take him back to court for more childsupport and primary custody

Re: custody agreement

You can always take someone to court for a modification of a child support agreement or custody question but the standard for a change in child support is, was there a significant change of circumstances since the original order or the last modification and the needs of the child. His moving in with his girlfriend alone is not enough to make that case.

As for a change of custody, you would need to prove that the circumstances warrant the court to change the fathers rights under the current custody arrangement. From what you have stated, I do not see that event as well.
