Getting custody back

If you test positive for a dirty urine while going through a custody battle does that give the judge the right to strip you of your rights and lose permanent custody of your children when the children want to return home and they are 6 and 4 but have come up clean for over 3 months and have never had more than 1 positive urine

A judge has a siginificant amount of lattitued in determining proper or improper custodial settings so without knowing more information, the short answer is yes, a judge could strip a parent of custody based upon one dirty test.
