Legal Question in Family Law in New York

custody battle between states

If a mother skips state with her child, and a year later the father finally finds a location as to where she is, can the father take legal action in the original state or would he have to go to the state the mother and child are now in? (original state is NY, the mother fled to IN)

Re: custody battle between states

You should consult with an attorney in NY as soon as possible to review ALL of the facts and make a determination whether NY can still exercise jurisdiction. The time that you have to take action in NY, if any, will be limited, so you are urged to contact our firm or another attorney qualified in this area of law as soon as possible.
