custody of my child

my ex has sole custody but i am afraid she is unfit. no job. mentaly disabled on foodstamps and home is not up to code.i want to gain custody of my child. she is still living with parents and both are diabled one is disabled for number of mental ilnesses and the other is physically dissabled niether work. i also need to know if i have any parental rights for my step daughter her father abandoned her and i am the only father she has. i was going through an adoption of her but my ex stopped it. she has a long history of violence and she has been to alcahol rehab

You do have an absolute right to claim custody of your child, the law however is quite diffrent with regards to step children. Had you completed the adoption process legally this child too would have been treated as your own child.

Carlso is correct, You can also pursue custody of the step child if your ex is a danger to the child.
