Legal Question in Family Law in New York

Custody of my daughter

I have a 10 month old baby and the father and i just split recently. I want them to have a relationship but i dont want him to be alone with her. with the things that i have been through with him hes too emotionally unstable. He thinks about wanting to kill people who upset him and that bothers me. i also have proof of this in emails. I'm not trying to deny his rights but its also hard letting him see her considering he doesn't have his licenses and hes not allowed in my moms home since she is scared. I do what i can but he wants her alone now and i dont like it. What is my chance of winning for sole custody and supervised visitations? i have been her main caregiver since she has been born. but i am a stay at home mom.

Re: Custody of my daughter

Since you have possession of the child you are ahead of the game.

You did not mention if you were married to the father or not.

Since there is no court order,he would have to go to court and establish his right to see the child.

At that time you can interpose a defense that he is unstable and would be a threat to the child. The court may compromise and order supervised visitation.

In any event you should seek the services of a family lawyer.
