Legal Question in Family Law in New York

custody issue

i plan to marry a man who has a high

paying job out of state, and who has

unsuccessfully applied for jobs in nys.

my divorce contract states that i cannot

move out of my children's school

district until they graduate (the

youngest is in 3rd grade) from high

school. when my ex heard about my

plan, he threatened with suing me. my

question is...can i move and still keep

my children as is? they live with me and

have visitation every other weekend and

for dinner once a week.

You can move but you may not be able to move your children without you ex's consent or a court decision that a modification in the agreement is in the children's best interest.
