Can my ex really get custody of my kids just because he can prove that he's had them for a year even if I had them majority of their life?

The standard to be used by the court is the "best interests of the child". The courts will look at who has recently been the primary caregiver of the children and then employ the best interests test. You should discuss your specific facts with an attorney to insure your rights are fully protected.
