Legal Question in Family Law in New York

Custody and moving

I have two daughters and am planning on moving out of the county I currently reside in. They have not seen their father since May,2003, he does not pay support or have visitation, but custody has never been established. Should I file for custody or notify him or his parole officer of the move?

Re: Custody and moving

Since there is no order of custody or visitation, then you are free to move. Since custody has not been established he does not have to pay child support. If you don't expect to receive child support since he may be unemployed, then there really is no reason to file for custody or notify him of where you move to. You are under no obligation to tell him anything absent a court order.
