Custody Relocation

How can a female friend of mine who has custody of her 8 year old son, relocate to another State? Her ex sees the boy only once a week and their divorce stipulates that she remain in NYC.

Your friend will have to seek permission from the Court for the relocation. Your friend will have to show that the relocation is in the best interests of the child. I suggest you consult with an attorney.

If the judgment states that the custodial parent has to remain within a certain radius of the non-custodial parent or within a given city - then she will have to file for a modification to allow such a relocation. The test will be the best interest of the child and usually requires extraordinary reasons. Good Luck!
