Legal Question in Family Law in New York

Custody Trial and No attorney: awaiting petition response

I received permission from the referee on our Custody Trial to petition for counsel fees in order to be able to have legal representation at upcoming custody trial. All was submited, yet no response has been received and trial is to start next week. I had planned to either (a) receive the $, retain attorney

for trial or (b) appeal if refused, as I feel I am correct on the law. Having received no answer, can I be forced to proceed to trial next week without counsel?

Re: Custody Trial and No attorney: awaiting petition response

You should contact the person in charge of granting your request for counsel to inquire about status. You should also contact the judge's chamber's and tell him/her that you are still awaiting decision on your request for counsel, and would like the trial postponed.

I would recommend that you telephone the Judge's chambers and send a letter requesting a response or an adjournment of the trial date.
