Legal Question in Family Law in New York

custody
when visitation & custody were awarded my son was just an infant. I recieved primary physical w/ visits allowed to his father. The living condition were his father resides are much less than ideal, he has no room, sleeps in the living room usually on the floor.I also raised the fact that his father abuses marijuana, will leave while my son is there to abuse and has also driven him home under the influence.All my concerns were dismissed in court ''it's just like a sleep over'' was stated.My son is almost 4 and the effects are starting to show in his behavior.There is no structure while he visits so when he comes home he rebels against everything.He has been phyically harmed by their neglence.I need to know where my legal standing is. I want him to know his father but not if it means under these circumstances.
