Legal Question in Family Law in New York

Custody/visitation

I have a court appointed lawyer that is not answering my questions, not taking time to prepare my case, meet with me, return my calls, or even be where she should be on court dates within the court house. There are a feww important issues within my case that she isn't paying any attention to. Is there anything I can do to have her replaced?, my case is about to go to trial.

You can make a motion (written request) to the court to substitute counsel, however, because your counsel is court appointed and paid for by the state, you will have a high burden to show that your state appointed counsel cannot represent you. Generally, one does not have the right to choose who is court appointed to represent them.

You can make a motion to the judge who will have the discretion whether to grant a replacement or not.
