dating someone who is separated

I am divorced and dating someone who is separated. Does he need to be legally separated in order to be dating me? thank you!

No he can date you without being legally separated but he would be committing adultary if he were to have sex with you before he is divorced. NY as you know requires fault in order to get a divorce. If she didn't have grounds before he dated you, she would have them once you sleep together.
